Sujet : "Justice is the same for all". Commentez cette affirmation.

Since the Ancien Greek civilization’s apogee, democraty is the best political regim in the world, because everybody is giving the same oppotunities. It’s a system where, officialy, all the citizens are “seen with the same eye”, or juged by the same justice. That’s why we can find a democratic system in about every country, except in rare dictatorship, of course. But even if the law affirm everybody is equal, like in the Declaration of Independence, we can wonder if in reality, this princip of equality is practiced. We’ll try to answer by, in a first time, explaining what mean the sentence “Justice is the same for all”, and after, we’ll say why we can say that there is a real equality in justice, and to finish, we’ll prove that there are still inequalities because of, for exemple, prejudices.
Here, we have to comment a sentence very litigious, because it affirms a general concept : the equality. Theses six words express a very huge notion, so we have to try before comment it, to explain it. It means that a man and a woman, a rich and a poor, a white and a black, an able and an unable will be seen only like Human by the Judge. It means also that your social statute won’t interpose in the trial. So, according to this sentence, and consequently, according to the law, you’ll have exactly the same punishment if you are white_skined, black_skined, a man or a woman... It’s like in France with the “Liberté – Egalité – Fraternité” which implies, principally with the second word, that everybody will receive the same retaliation for the same act, like said in the Declaration of Independance. But are thoses affirmations correct ?
If we look at laws and judicial texts, we’ll think there is a real equality between all the citizens who are considered with the same rights each other. We’ll believe that because everybody born “equal in rights”, according to the begining of Declaration des Droits de l’Homme et du Citoyen, the French principal Constitution. It’s an important article because it sets the foundations of juricial and social equality for all, whereas before, there was different privileges for nobles and peasants, for riches and poors, so it was an unfair system, meaning a non-existing justice. But since 1789 in France, or 1776 for United States, this tyranical system has been passed and changed for the democraty, who is better for everybody, exept the olds dictators. In the new laws, even if there has been some problems after, like the Apartheid, every defendants or every crime receive a same justice, a fair justice, without racist or sexist discriminations. But even if it’s wroten in the most known texts, it’s not always practiced in the real life...
In reality, justice is sometimes very impartial, and doesn’t punish by the same penalty two inmates who have made the same crime. It could be done because of racism, sexism or an other sort of discrimination, but in all the case, it’s outrageous, and doesn’t respect democraty’s holly concept. For exemple, we can talk about a recent evenement which has taken place in USA : an old black man, who had only a knife, had been let down and hitten by five policemen. After this lynching, there has been a trial, and the Judge has been clear : American Justice agreed withs the cops ! We can think thath if the old man was withe_skined, the five policemen wouldn’t have hit him, and, even if they’d do it, justice would have made an other choice, better for the white man... And we can also find other discrimination into the Justice, notably with the Well-offs, who can corrupt judges to have a better sentence, whereas a badly-off won’t be able to do that... It’s an other kind of injustice...
We can now explain if “justice is the same for all”, or if it isn’t. If we try to answer by reading judicial texts, we’ll think that yes, everybody in a democraty has the same right and so, is juged by the same justice. But if we try to anwer by studying the reality, we’ll directly see that there are still great inequalities because of prejudices and close-minded people who don’t see the real life... So, even democraty have to improve its equality !
