Juste pour vous dire: en téléchargeant Virgin Suicides, un film de la Paramount, je me suis fait repérer sur eMule. Paramount a envoyé un mail à Club-Internet, qui me l´a transmis.
J´ai juste été prévenu, je risque une forte amende si je récidive.

Bref, je vous préviens juste: téléchargez tant que vous voulez, mais surveillez votre boite mail. Si on vous chope, arrêtez tout, et restez un peu calme qqs temps.

Comme certains abrutis m´ont traités de mytho ( je vois pas pkoi, j´ai aucune gloire à tirer, et j´ai aucun intérêt à vous faire peur, je touche pas de pourcentage sur les DVD), je vous laisse une copie du mail recu. Je l´ai un peu censuré ( adresses IP et numéros ID) en remplacant qqs chiffres par des X. Mais ca ne gène aucunement la compréhension.

Surtout si vous êtes chez Club Internet vous avez du soucis à vous faire ( il y a d´autres messages sur les forums d´utilisateurs qui ont eu le meme problème mais je n´ai vu que des utilisatuers de Club Internet).

Qu´est-ce que je risque si je télécharge en peer to peer un fichier au format DivX ou MP3 ?

Vous risquez d´être accusé de contrefaçon ( ou au moins de recel ou de complicité), délit puni d´une peine maximale de deux ans de prison et 150 000 euros d´amende maximum ( article L 335-2 du code de la propriété intellectuelle). En outre, l´auteur ou ses ayants droit pourront demander en justice votre condamnation à des dommages et intérêts pour réparer le préjudice commercial subi. En pratique, les tribunaux français n´ont pour l´heure jamais prononcé de telles peines maximales à l´encontre d´internautes. Le tribunal correctionnel de Lille a récemment condamné un utilisateur à trois mois de prison avec sursis et à verser 3 000 euros de dommages et intérêts pour l´échange, en P2P, de compilations de CD-Audio gravées. Concrètement, les tribunaux prennent en compte différents éléments ( le nombre de fichiers téléchargés ou mis en partage, l´utilisation qui en est faite : utilisation privative ou à titre commercial). On pourrait en effet penser qu´il y a une différence entre mettre des fichiers piratés en partage et seulement les télécharger.
