MANSFIELD, Ohio - A former teacher convicted of having a sexual relationship with a middle school girl won´t spend any time behind bars, and now the girl´s mother is speaking out about his sentence.
Dustin Powers, 36, resigned from his position as gym teacher at John Simpson Middle School and gave up his teacher´s license in June after pleading guilty to sexual battery, 10TV´s Brittany Westbrook reported.
While Powers faced up to five years in prison for his relationship with the 13-year-old, a judge on Wednesday sentenced him to just probation, Westbrook reported.
The girl´s mother told 10TV News that the sentence was a slap in her face.
"It just felt like a big slap in my face," she said. "I had just got up there and pleaded to the judge it meant nothing, meant nothing at all."
The mother said she found out about the relationship immediately after waking up from a dream and looking in her daughter´s diary.
"I had a dream about her journal and it was just flapping, just flapping," she said. "I got up from my nap and it was there on her bed. The first page; I opened it up to that´s how I found out."
The mother said Powers´ words lured her daughter and convinced her that she and her teacher were in love, Westbrook reported.
Assistant Prosecutor John Boyd told 10TV News that he too was dissatisfied with the judge´s decision.
"(Powers) took the innocence of a young girl," he said, "but the judge felt that he was not a dangerous person and that he was remorseful for what he had done."
10TV News looked at three other cases of teachers who were convicted of sexual conduct with students in Richland County. Some received jail time, others did not, Westbrook reported.
